2. Information We Collect
We collect information you provide directly to us, including your name, email address, and phone number when you request a demo or interact with our maintenance triage systems.
We may also collect usage data such as the content of SMS messages sent to or from a HabitGuard number as part of the maintenance coordination service, solely for the purpose of providing and improving that service. All maintenance-related interactions are logged with timestamps to generate compliance records in accordance with California Civil Code ยง 1941.1 habitability requirements.
3. SMS & Mobile Information Sharing (Carrier Compliance)
No mobile information, phone numbers, or SMS data will be shared with third parties or affiliates for marketing or promotional purposes. Mobile opt-in data and consent are never shared with any third party for any purpose.
SMS message content, mobile phone numbers, and SMS opt-in consent records are excluded from all other data sharing categories described in this policy. This information will not be shared, sold, rented, leased, or otherwise transferred to any third party for any reason, including marketing, advertising, analytics, or affiliate programs.
We do not sell, rent, or lease our customer lists, mobile numbers, or SMS subscriber information to third parties under any circumstances.
HabitGuard's SMS program is used solely for maintenance coordination, demo scheduling, and service notifications. It is not used for marketing or promotional messaging.
SMS data may only be disclosed to service providers strictly necessary to deliver the messaging service (e.g., our SMS infrastructure provider, Twilio), and only to the extent required to transmit messages on our behalf. These providers are contractually prohibited from using mobile data for their own marketing purposes.
4. SMS Consent & Opt-Out
HabitGuard operates three distinct SMS programs, each with its own consent mechanism:
- Demo & Service Coordination (Property Managers): By providing your phone number and submitting our demo request form, you consent to receive SMS messages from HabitGuard for demo scheduling and service coordination purposes.
- Maintenance Requests (Tenants): Tenants of property management firms that use HabitGuard opt in by initiating contact — texting a HabitGuard-assigned maintenance number provided by their property manager. The tenant's first inbound message constitutes consent to receive maintenance-related responses. Upon first contact, tenants receive a confirmation message with opt-out instructions, help information, message frequency disclosure, and a statement that message and data rates may apply. No messages are sent to tenants prior to their initial inbound text.
- Job Dispatch & Coordination (Vendors): Field service vendors receive an opt-in request before any job content is delivered. Vendors must reply YES before receiving dispatch messages. No dispatch messages are sent to a vendor number until affirmative consent is confirmed.
- Opt-Out: Any user may reply STOP at any time to opt out of further messages. A confirmation will be sent and no further messages will follow.

5. Data Security
We implement industry-standard security measures to protect your data. Sensitive operational data transmitted through our AI agents is encrypted in transit and stored securely. We do not retain SMS message content beyond what is necessary to provide the maintenance coordination service.
6. Changes to This Policy
We may update this Privacy Policy from time to time. Changes will be reflected by the "Last Updated" date at the top of this page. Continued use of our services after any changes constitutes acceptance of the updated policy.
